Terms and Conditions of Holiday Rentals



The terms and conditions of the holiday letting as agreed by both parties are as follows and departure from same by you permits the owner or the agent to refuse the key or immediately terminate the occupancy.


RESPONSIBILITY FOR THE BOOKING: The actual guest (or guests) making the booking and who has been accepted by the Agency must occupy the property for the duration of the booking. This person/s will be held responsible for the conduct and behaviour of all guests.

RESERVATION FEE & FINAL PAYMENT: To secure a holiday booking, payment of 50% deposit is required as
confirmation within 7 working days of making the booking together with a booking fee of $25.00. The balance of 50% must be received by us 30 days prior to commencement of the booking. If the booking commences in less than 30 days, the full amount is required when booking. All payments are to be made by bank cheque, Visa, Mastercard, eftpos or bank transfer. The premises are let to you for holiday purposes only for the period stated on the receipt. All credit card transactions incur a 2% Merchant Fee.

HOLIDAY BOOKING FEE: A non-refundable fee of $25.00 applies to all holiday bookings.

SECURITY DEPOSIT (Bond): A credit card authorisation form must be completed prior to your booking, this is held on file until satisfactory inspection upon vacating the property. Should you not have a credit card a $1000 bond will apply.

CHECK IN AND VACATING TIMES: The premises will be available for occupation from 2pm on the day of arrival and are to be vacated by 10am on the day and will incurr an additional nights payment unless prior arrangements are made with agent. During the December/January period the check in time is 3pm on the day of arrival and keys to be returned by 9.00am on the day of departure. All times quoted are local. Keys are to be returned to us upon vacating the premises.

CANCELLED BOOKINGS: IN ALL CASES cancellations incur a $200 cancellation fee.

The balance of the deposit will be refunded for cancellations notified in writing to us no less than 90 days prior to the commencement of the booking.

For cancellations notified to us in writing less than 90 days prior to the commencement of booking the deposit will only be refunded if the property is re-let for the full period at the full tariff in line with the initial booking.

CHANGES TO BOOKINGS: All bookings are made in good faith by our office, however, may be subject to change from time to time. Please note that we cannot be held responsible for actions by owners of the premises or other situations that may be out of our control. Naturally in the event that the property is no longer available we will make every effort to secure alternate accommodation.

NUMBER OF PERSONS: The number of occupants must not exceed the number stated when booking. Should you exceed this number your booking will be terminated.

LINEN: Linen is not provided in most properties. Linen can be hired from byronbaylinenhire.com.au or phone 02 6685 6247 or 0408 405 825.

KEYS: Keys will not be made available until all monies have been paid in full. Arrangements for collection of keys outside office hours should be made prior to arrival.

PETS: Pets ARE NOT PERMITTED in any premises managed by us unless otherwise stated and agreed to by agent.

BOOKING CONDITIONS: Advance bookings are accepted by us in good faith on behalf of the property owner, however we cannot accept responsibility for the following circumstances - where the property is sold; the tariff is increased prior to your occupation; the property is altered in any way; the malfunction of any inventory items; the property is withdrawn from letting; noise, inconvenience or loss of view caused by building construction on neighboring or nearby properties. Every attempt will be made to offer alternative accommodation in these circumstances.

DAMAGES & BREAKAGES: All damages and breakages or loss to the premises and/or furniture and furnishings are to be reported to us and paid for by the guest immediately. Should you discover a default or breakage when you arrive please advise or we will consider those the responsibility of the current guest and charge accordingly.

DAMAGES, LOSS OR THEFT OF GUESTS PROPERTY: No responsibility is taken for guests personal property left on the premises. Landlord’s insurance does not cover loss of guests’s belongings.

DESCRIPTIONS: All bookings including those made by telephone, facsimile, e-mail or mail are made in good faith by us and descriptions are given to the best of our knowledge. We cannot be held responsible for bookings without prior inspection by the tenant if accommodation is unsatisfactory on arrival. No refund is given if you are not satisfied with your accommodation.

CLEANING: Please assist by leaving the premises clean and tidy, with cutlery and cooking utensils washed, put away, and any soiled mattress protectors, pillow protectors and bedspreads laundered, or additional cleaning fees will be charged.

CLEANING BBQ: If a BBQ is provided and not satisfactorily cleaned an additional fee of $50-00 will be charged.

NOISE: No person on the premises shall conduct themselves so as to cause a nuisance to adjoining or neighbouring occupants. In units, Strata Title by-laws and regulations must be observed.

No private functions are to be held at rental properties without written consent of the owner. A fee will be charged against the bond if security is called out due to noise complaints and further disturbances may result in your removal from the premises.

SALE PROPERTIES: In the event of the property being offered for sale the tenant agrees to allow the owner or his Agent to inspect the property with prospective purchasers during reasonable hours by appointment.

ACCESS: The tenant agrees to allow the Agent or his nominee to enter the rented premises to arrange necessary repairs.

GENERAL: Occupants locked out of the premises requiring assistance from us to gain entry after hours are required to pay a call out fee of $50. If the service of a locksmith is required this must also be paid by the guest. Guests are responsible for all costs relating to lost keys.

GARBAGE: Tenants are requested to put wheelie/recycle bins out on Monday nights.

INSPECTIONS: Guests must allow the Agent or his representatives, to enter the premises to carry out repairs or inspections if they feel this is necessary or if the Agent feels the guest is in breach of these Terms & Conditions.

TERMINATION: Failure to observe these Terms and Conditions will grant the Agent the immediate right to terminate any booking or occupancy.

FURNITURE: Is not to be moved and only outdoor furniture is to be used outdoors.
